These terms are an agreement between you (the business that creates an account) and [Legal business name] ("we", "us"), the company behind (the "service"). By creating a shop or using the service, you agree to them.
A time clock for small businesses: your crew punches in and out on a tablet, and your office sees hours, overtime estimates and gross-wage estimates. It is a record-keeping and calculation tool. It is not a payroll service, it does not pay anyone, and it does not calculate deductions (income tax, CPP, EI, vacation or holiday pay).
You are responsible for paying your people correctly and for following the employment laws that apply to you (overtime, breaks, rounding, record keeping). The service offers defaults by province as a convenience; check them against your province's rules, and review flagged shifts before you run payroll. We are not a substitute for an accountant, payroll provider or lawyer.
You enter your employees' names and may enter pay rates, PINs, email addresses and notes. You confirm that you are allowed to do so and that you will tell your crew that their punches are recorded by this service. See our Privacy Policy for how we protect that information.
Don't use the service to break the law, to record people without the right to do so, to attack or overload the service, or to try to reach another business's data. We may suspend accounts that do.
We work to keep the service running all the time, and the tablet keeps recording punches during internet outages, but we can't promise the service will never be interrupted. We may improve or change features; if we ever discontinue the service, we will give at least 60 days' notice and a way to download your data.
The service is provided "as is". To the extent the law allows, we are not responsible for indirect losses (lost profits, fines, claims by employees) that result from using the service, from an interruption, or from relying on its calculations. Our total responsibility to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights that consumer or other laws give you and that cannot be limited by contract.
You can close your account at any time. We can end the agreement if you break these terms, with notice where reasonable. Sections 6, 9 and 11 continue after the agreement ends.
